Terms of Sale & Service

DRAFT — pending legal review. This is a working draft published for transparency. It has not yet been reviewed by an attorney and is not yet in force. Notes marked [ATTORNEY: …] are open questions for that review.

These terms cover buying Saykeep and using this website. They are written to be read, not skimmed past. The license for the app itself lives in the EULA, and how refunds work lives in the Refund Policy — both are part of these terms.

1. Who you’re dealing with

Saykeep is made and licensed by [ATTORNEY: licensor’s legal name, form, and registered address] (“Saykeep”, “we”). Your purchase contract, though, is with Lemon Squeezy, our merchant of record [ATTORNEY: verify the MoR’s current legal name and entity details]. As merchant of record, Lemon Squeezy is the seller: it processes your payment, collects and remits applicable taxes such as VAT, issues your invoice, and handles your payment data under its own terms and privacy policy. We never see your card details. Your card statement will show LEMSQZY*.

2. What you’re buying

A one-time purchase: $39, or $29 at the launch price until September 1, 2026. There is no subscription and nothing recurring. Your money buys a personal license to the Saykeep desktop app — your license, on all the machines you personally use — under the EULA. Every v1.x update is free, through at least the current and the next major macOS release. A future major version (v2.0) may be an optional paid upgrade at an owner discount; whether you take it or not, your v1 keeps working.

3. The free trial

Saykeep comes with a 30-day free trial: all features, no credit card, no account. When the trial ends, new capture is gated but everything you already recorded stays browsable and exportable. We gate compute, never your files.

4. Delivery and your license key

Saykeep is delivered digitally. After checkout, Lemon Squeezy emails you the download and your license key. The key is a signed license verified offline inside the app — no activation server, no account, no phone-home. Keep the key somewhere safe: pasting it into Saykeep on any machine you personally use is the whole activation process.

5. Refunds and the right of withdrawal

Every purchase carries a 30-day money-back guarantee, no questions asked, and EU consumers additionally hold a statutory 14-day right of withdrawal. How both work, and how refunds are executed through Lemon Squeezy, is set out in the Refund Policy, which is part of these terms.

6. Privacy

Saykeep is local-first: no accounts, no telemetry, no cloud sync. Your audio and transcripts stay on your machine, except what you choose to send to the LLM endpoint you configure. The full, verifiable picture — including every connection the app can make — is on the privacy page. Checkout is the separate exception: it runs on Lemon Squeezy’s systems under Lemon Squeezy’s privacy policy.

7. Support

Support is best-effort from a small team, with a refund-first stance on problems we can’t reproduce. The details, including the published support horizon for v1, are in the support policy.

8. Your responsibilities

Saykeep records audio, and recording laws differ by place. Whether you may record a given conversation depends on the law where you and the other participants are; obtaining any required consent is your responsibility, as the consent FAQ explains. You agree to use Saykeep and this website lawfully and within the EULA.

9. Warranties and liability

We build Saykeep with care and we stand behind it with the guarantee above. Beyond that, to the extent the law that applies to you permits: the app and this website are provided “as is”, we disclaim implied warranties, and our total liability arising out of these terms or your use of Saykeep is limited to the amount you paid for it. Nothing here excludes liability that cannot lawfully be excluded, and nothing here limits the mandatory rights you have as a consumer, including conformity rights for digital content under EU and Polish consumer law. [ATTORNEY: verify the disclaimer and liability cap against Polish/EU consumer and digital-content-conformity rules]

10. Governing law and disputes

These terms are governed by the law of Poland [ATTORNEY: confirm the choice of law and the consumer carve-outs]. If you are a consumer, this choice does not deprive you of the protection of mandatory rules of the country where you live, and you may be able to bring or defend claims in your local courts. We would much rather fix a problem than litigate it — write to us first. [ATTORNEY: advise which out-of-court dispute-resolution notices are required for EU/Polish consumers]

11. Changes to these terms

We may update these terms from time to time for future purchases. The version in force when you buy is the version that applies to your purchase; the date at the top tells you when the current version last changed.

12. Language

These terms are written in English and translated into Polish for convenience. If the versions diverge, the English version controls. [ATTORNEY: verify a controlling-language clause holds toward Polish consumers]

13. Contact

Questions about these terms: support@saykeep.app. Questions about a charge, an invoice, or VAT are handled by Lemon Squeezy as merchant of record — but you can always start with us and we’ll point you the right way.
